APPLICANT REQUESTS THAT:

His DD Form 214, Certificate of Release or Discharge from Active 
Duty, be updated to reflect award of two (2) Bronze Service Stars 
(BSSs) for his previously awarded Vietnam Service Medal (VSM).


APPLICANT CONTENDS THAT:

He was transferred to U-Tapao Airfield, Thailand from 7 Jul 72 to 
6 Jul 73.  During his tour of duty in Thailand, he was involved 
with two campaigns:  Linebacker I from 9 May-29 Oct 72 and 
Linebacker II from 18 to 29 Dec 72.  

The Board should find it in the interest of justice to consider 
his untimely application because he did not realize the BSSs were 
missing from his records until he was discussing it with other 
veterans.

STATEMENT OF FACTS:

On 27 Dec 70, the applicant enlisted in the Regular Air Force.

According to a 22 Mar 75 base level military personnel system 
report in the applicant’s military personnel records, he served 
overseas duty from 7 Jul 72 to 7 Jul 73. 

On 7 Apr 76, the applicant received an honorable discharge.  He 
was credited with 5 years, 3 months and 11 days of active service.   


AIR FORCE EVALUATION:

AFPC/DPSID recommends disapproval for award of a second BSS for 
his VSM.  After a thorough review of the applicant’s official 
military personnel record, they were able to verify award of the 
VSM with 1 BSS.  However; they were unable to verify award of a 
second BSS.  Campaigns Linebacker I and Linebacker II are not 
designated campaigns used for determining service stars for the 
VSM.  The applicant’s dates in Vietnam do not coincide with more 
than one approved campaign; therefore, he is not eligible for a 
second BSS for his VSM.  

A service star (bronze or silver) is authorized for each campaign 
under the following conditions:  Assigned or attached to and 
present for duty with a unit during the period in which it 
participated in combat.  Under orders in the combat zone and in 
addition meets any of the following requirements:  Awarded a 
combat decoration; furnished a certificate by a commander general 
of a corps, higher unit, or independent force that the service 
member actually participated in combat; served at a normal post of 
duty (as contrasted to occupying the status of an inspector, 
observer, or visitor).  Aboard a vessel other than in a passenger 
status and furnished a certificate by the home port commander of 
the vessel that he served in the combat zone. 

DPSID determined that the below Air Force Medals and/or Ribbons 
should have been awarded during the applicant’s service from 
27 Dec 70 to 7 Apr 76 and were not reflected in his records.  Upon 
final Board decision, administrative correction of the applicant’s 
official military personnel record will be completed by 
AFPC/DPSOR:

VSM w/1 BSS and the Republic of Vietnam Gallantry Cross with Palm 
(RVNGC w/P).

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant 
on 26 Sep 14 for review and comment within 30 days (Exhibit D).  
As of this date, no response has been received by this office.


THE BOARD CONCLUDES THAT:
1.  The applicant has exhausted all remedies provided by existing 
law or regulations.

2.  The application was not timely filed; however, it is in the 
interest of justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented to 
demonstrate the existence of an error or injustice to warrant 
corrective action.  We took notice of the applicant’s complete 
submission in judging the merits of the case; however, we agree 
with the opinion and recommendation of the Air Force office of 
primary responsibility and adopt the rationale expressed as the 
basis for our conclusion that relief beyond that already granted 
administratively is not warranted.  Therefore, in the absence of 
evidence to the contrary, we find no basis to grant the relief 
sought in this application.


THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented did not 
demonstrate the existence of material error or injustice; the 
application was denied without a personal appearance; and the 
application will only be reconsidered upon the submission of newly 
discovered relevant evidence not considered with this application.
